1. Define where it will operate
Where the business operates matters. Choosing a state because of a promotion may create additional obligations elsewhere. Explain where you will work and have customers, employees or facilities so the scope can be reviewed with an appropriate professional.
2. Describe the activity
Forming an entity and obtaining permits are different steps. Depending on activity and location, licenses, tax registrations and local requirements may apply. LLC formation does not replace them.
3. Organize ownership
Identify the owners and who can authorize filings. Decisions about internal agreements, responsibilities and tax treatment should be reviewed with the appropriate professionals.
4. Separate the charges
Ask for a quote that identifies assistance fees, state fees and outside expenses. The IRS issues EINs for free; a private company may charge to help you apply.
5. Prepare for what follows
Keep documents, separate business activity and organize a calendar of obligations. Formation approval is the start of consistent administration.
